Terms of Use

These Terms of Use are between you and Pointaris / Directional Interface. They cover this website, the waitlist, and the Pointaris app and directional guidance when you use them (together, the “Service”).

By using the site, joining the waitlist, or using the app or guidance, you agree to these terms. If you do not agree, do not use the Service.

Pointaris is a human-guided navigation product. One person (the guide) can send directional feedback to another person (the receiver) during a temporary session. Feedback can include turn, speed, and stop cues, sound, vibration, and a path drawn on a map.

The Service is a communication and advisory tool. It is not an autonomous driving system, a traffic-control system, an emergency service, or an official source of road rules. Marketing lines on this site, including promises to “guide someone,” are descriptions of the idea. They are not a warranty that any trip will be safe, legal, or successful.

Directions, routes, cues, maps, speeds, arrival estimates, and other information from Pointaris are advisory only. They are not a substitute for your attention, your judgment, or the traffic laws that apply where you are.

Look at the road, the people around you, and the conditions in front of you. A cue on a screen, a spoken prompt, a beep, or a vibration does not mean a maneuver is safe or legal. If a cue conflicts with what you see or with the law, ignore the cue.

Do not use Pointaris while driving or operating a vehicle, bicycle, scooter, or other machine if doing so distracts you or is against the law. Keep your eyes on the road and your hands on the controls.

A passenger may use the Service when that is safer and allowed where you are. You are responsible for knowing and following local laws on phones and devices, including hands-free rules. If you cannot use the Service safely, stop in a lawful place before looking at it, or do not use it.

Audio and vibration can surprise you. Set volume and alerts so they do not startle you or cover sounds you need to hear, including sirens and horns.

Obey all traffic laws, signals, road signs, lane markings, speed limits, and directions from police and other officials. Watch for people walking or cycling, other vehicles, weather, animals, construction, closed roads, and any other hazard.

Never follow guidance into an unsafe, illegal, or unclear situation. Do not turn, change lanes, speed up, slow down, or stop just because a cue says so. The real road controls.

You use routes, turns, speed cues, drawn paths, and any other guidance at your own risk. You decide whether to move, and how.

To the fullest extent permitted by law, Pointaris, Directional Interface, and their operators are not liable for accidents, collisions, injuries, death, property damage, tickets, tows, missed turns, wrong destinations, late arrival, or any other harm from relying on the Service. Navigation can fail. Following a cue can still lead you the wrong way.

GPS, location, speed, heading, maps, road geometry, traffic, and similar data can be inaccurate, delayed, incomplete, outdated, or unavailable. Signals drop. Maps miss new roads, private roads, and closures. A blue dot can sit in the wrong place. A drawn path can snap to a road you did not mean.

Do not assume the map matches the world in front of you. The Service does not guarantee that any route is the shortest, fastest, or safest, or that you will reach a destination.

A session is between people you choose to connect. Pointaris does not drive the vehicle and does not supervise the session. Both the guide and the receiver are responsible for safe use.

• The receiver decides whether to follow any cue and must travel lawfully and attentively.
• The guide must not send reckless, illegal, or unsafe guidance. That includes directions into hazards, instructions to break a speed limit or a signal, and anything meant to distract the person who is moving.
• Either person should end the session if it becomes unsafe or confusing.
• Pointaris does not guarantee that the other person is who they claim to be, that they are fit to travel or to guide, or that they will act carefully.

Do not use the Service while impaired by alcohol, drugs, fatigue, or anything else that affects your ability to travel or to give guidance. Do not use the Service to encourage impaired driving or other unsafe travel.

The Service is not directed to children. A minor may use it only with a parent or guardian involved, and only as the law allows. A parent or guardian is responsible for a minor’s use.

Joining the waitlist, or sending a message through this site, does not create an account, start a paid plan, or guarantee access, a license, a partnership, or a reply.

The waitlist form on this site is a preview. It checks that an email looks valid, then discards it. Submissions are not stored, and no email is sent. Pages on this site are informational and can change.

The site may list issued U.S. patent numbers as identifiers. A listing is not a license, an assignment, or an offer to license. Patent rights stay with their owners.

Do not misuse the Service. You will not use it to break the law, to harm or harass someone, to send guidance you know is dangerous, to interfere with the site, or to reach data you are not allowed to access.

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Pointaris and Directional Interface disclaim all warranties, whether express or implied. That includes warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be accurate, safe, uninterrupted, or error-free, or that guidance will prevent a crash or take you where you meant to go. Some places do not allow certain disclaimers. In those places, the disclaimer applies only as far as the law allows.

To the fullest extent permitted by law, Pointaris, Directional Interface, and their operators, including Brian Dean Owens, will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, or for personal injury, death, or property damage, arising out of the Service or these terms. This applies whether a claim is based on warranty, contract, tort (including negligence), or any other theory, and even if we were told the harm was possible.

To the fullest extent permitted by law, our total liability for any claim arising out of the Service will not exceed the greater of the amount you paid Pointaris for the Service in the twelve months before the claim, or one hundred U.S. dollars (US $100). If you paid nothing, the cap is US $100.

Some jurisdictions do not allow certain limits. In those places, the limits apply only as far as the law allows. Nothing in these terms limits liability that cannot legally be limited, including liability for fraud or for willful misconduct where the law forbids that limit.

You will defend and indemnify Pointaris, Directional Interface, and Brian Dean Owens against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, guidance you give or follow, your travel, your violation of these terms, or your violation of law or of someone else’s rights. That includes claims by a guide, a receiver, a passenger, or another person connected to a session you joined.

These terms are governed by the laws of the State of Texas and the applicable laws of the United States, without regard to conflict-of-law rules. Courts located in the State of Texas are the venue for disputes, except where the law gives you a right to bring a claim somewhere else that cannot be waived.

Texas is the governing-law placeholder for this draft. Counsel should confirm the entity, venue, and any required consumer notices before these terms are relied on in production.

We may update these terms by posting a new version on this page and changing the effective date. If you keep using the Service after an update, you accept the updated terms. This document is a draft, so expect it to change after legal review.
